9. EXCLUSION OF WARRANTIES

(1) ANY RELIANCE PLACED BY YOU ON THE COMPLETENESS, ACCURACY OR EXISTENCE OF ANY ADVERTISING, OR AS A RESULT OF ANY RELATIONSHIP OR TRANSACTION BETWEEN YOU AND ANY ADVERTISER OR SPONSOR WHOSE ADVERTISING APPEARS ON THE SERVICE;

(2) ANY CHANGES WHICH WE MAY MAKE TO THE SERVICES, OR FOR ANY PERMANENT OR TEMPORARY CESSATION IN THE PROVISION OF THE SERVICES (OR ANY FEATURES WITHIN THE SERVICES);

(3) THE DELETION OF, CORRUPTION OF, OR FAILURE TO STORE, ANY CONTENT AND OTHER COMMUNICATIONS DATA MAINTAINED OR TRANSMITTED BY OR THROUGH YOUR USE OF THE SERVICES;

10.2 ANY OTHER LOSS WILL BE LIMITED TO THE AMOUNT PAID BY YOU TOKalodata WITHIN THE LAST 12 MONTHS.

10.3 YOU AGREE NOT TO USE OUR PLATFORM FOR ANY COMMERCIAL OR BUSINESS PURPOSES, AND WE HAVE NO LIABILITY TO YOU FOR ANY LOSS OF PROFIT, LOSS OF BUSINESS, LOSS OF GOODWILL OR BUSINESS REPUTATION, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS OPPORTUNITY.

10.4 IF DEFECTIVE DIGITAL CONTENT THAT WE HAVE SUPPLIED DAMAGES A DEVICE OR DIGITAL CONTENT BELONGING TO YOU AND THIS IS CAUSED BY OUR FAILURE TO USE REASONABLE CARE AND SKILL, WE WILL EITHER REPAIR THE DAMAGE OR PAY YOU COMPENSATION. 5.2 您了解并知晓知识产权的重要性，作为您访问和使用服务的条件，您同意不使用服务侵犯任何知识产权。无论提前通知与否，我们保留随时自行决定阻止侵犯或涉嫌侵犯任何版权或其他知识产权的任何用户访问和/或终止其帐户的权利。

6.1 kalodata注重保护您的个人信息及个人隐私，绝对尊重您的个人隐私权，不会擅自公开、编辑、透漏您的隐私信息给第三方，除非有法律和政府的强制规定或是您的同意，具体详见《隐私政策》。

6.2 您应当在仔细阅读、充分理解《隐私政策》后使用kalodata的产品或服务，如果您不同意《隐私政策》的内容，将可能导致kalodata的某些产品或服务无法正常运行，或者无法达到kalodata拟达到的服务效果。您使用或继续使用kalodata提供的产品或服务的行为，都表示您充分理解和同意《隐私政策》（包括更新版本）的全部内容。

七、保密条款

您承诺对因使用我们的服务而知悉的商业机密和敏感信息予以保密，未经我们书面同意不得向任何第三方透露，但该信息已为公众所知悉或在您未违反保密义务之前已经公开获得的除外。

八、赔款

如您的行为（包括但不限于您或您帐户的任何用户违反本条款或与本条款相关的其他义务、陈述和保证等）而使Kalodata运营公司及其母公司、子公司和关联公司，以及他们各自的高级职员、董事、员工、代理和顾问等遭受损失或承担了相应责任，上述任何主体均有权向您进行追责，您应赔偿上述主体的全部损失。

九、排除担保

9.1 服务条款中的任何内容均不影响您以合同方式同意更改或放弃的任何法定权利，并且在法律上始终享有作为消费者的权利。

9.2 服务按“原样”提供，我们不对您提供任何保证或陈述。需要提请您特别注意，我们不能对您做如下保证：

9.2.1 您对服务的使用将满足您的要求；

9.2.2 您对服务的使用将是不间断的、及时的、安全的及无误的；

9.2.3 您因使用服务而获得的任何信息将是准确或可靠的；

9.2.4 服务中任何软件的操作或功能上的缺陷将得到纠正。

9.3 除非在服务条款中明确规定，否则任何条件、保证或其他条款（包括任何关于令人满意的质量、适用性或符合描述的暗示条款）均不适用于服务。基于业务和运营原因，我们有权在未提前通知情况下随时更改、暂停、撤销或限制我们平台的全部或任何部分的可用性。

十、责任限制

10.1 服务条款中的任何内容均不得排除或限制我们根据适用法律无法合法排除或限制的损失责任。这包括因我们的疏忽或我们的员工、代理或分包商的疏忽以及欺诈或欺诈性虚假陈述而造成的死亡或人身伤害的责任。基于上述，我们对如下情况不承担责任：

（4）您未能向我们提供准确的账户信息或者您未能保护您的密码或帐户详细信息的安全和机密。

10.2 任何其他损失将限于您在过去 12 个月内向Kalodata支付的金额。

10.3 您同意不将我们的平台用于任何商业或商业目的，我们对您的任何利润损失、业务损失、商誉或商业声誉损失、业务中断或业务机会损失不承担任何责任。

10.4 如果我们提供的有缺陷的数字内容损坏了属于您的设备或数字内容，并且是由于我们未行使审慎义务及专业技能而导致的，我们将修复损坏部分或向您支付赔偿金。但是，对于您本可以通过遵循我们的建议来应用免费提供给您的更新而避免的损害，或者由于您未能正确遵循安装说明或未达到我们建议的最低系统要求而造成的损害，我们概不负责。无论我们是否被告知或应该意识到发生此类损失的可能性，条款中关于我们的责任限制均应适用。

10.5 您应对因使用我们的服务而产生的任何移动费用负责，包括短信和数据费用。如果您不确定这些费用可能是多少，您应该在使用服务之前询问您的服务提供商。

11.1 Kalodata网站上的信息按“原样”提供。 Kalodata 不作任何明示或暗示的保证，并在此否认所有其他的保证，包括但不限于对适销性、特定用途的适用性或不侵犯知识产权或其他侵犯权利的默示保证或条件。此外，Kalodata不保证或就其 Internet网站上或与此类材料或与本网站链接的任何网站上的信息的使用的准确性、可能的结果或可靠性作出任何陈述。

11.2 本服务条款的解释和适用以及与本服务条款有关的任何纠纷均由我们最终解释和决定。

十二、法律适用与其他

12.1 本服务条款之订立、生效、解释、修订、补充、终止、执行与争议解决均适用中华人民共和国大陆地区实体法律；如法律无相关规定的，参照商业惯例及/或行业惯例。

12.2 您因使用服务所产生及与Kalodata有关的争议，由Kalodata运营公司与您协商解决。协商不成时，应提交深圳国际仲裁院进行仲裁。
